This Privacy Policy describes how Firedance Multimedia LLC (“Firedance,” “we,” “us,” or “our”) collects, uses, discloses and protects information about you in connection with the website at firedance.io (the “Site”), the Firedance mobile and desktop applications (the “App”), the FirePod hardware and its embedded software and firmware (“FirePod”), and any related services (together, the “Services”). By using the Services, you acknowledge that you have read and understood this Privacy Policy.
1. Information we collect
Depending on how you use the Services, we may collect the following categories of information.
Information you provide
This includes your email address and any other details you submit when you sign up for updates, create an account, contact us, or take part in a survey, beta program or promotion.
Information collected automatically
When you use the Services, we and our service providers may automatically collect technical and usage information, such as device and browser type, operating system, app version, language, approximate location derived from your IP address, dates and times of access, and information about how you interact with the Services.
Information from the App and FirePod
To provide the Services, the App and FirePod may process information about your devices and settings, such as paired devices, lighting configuration, preferences, playback status, and diagnostic and performance information. Much of this processing takes place on your own devices and home network. Where information is transmitted to us, we describe the purpose in this Privacy Policy or at the point of collection.
Information from third-party services
If you connect a third-party service, such as a music service or smart-home platform, we receive the information that service makes available to us under your authorization and its terms. We do not receive your credentials for those services unless we say so at the time you connect them.
2. How we use information
We use information to:
- provide, operate, maintain and secure the Services;
- set up and manage your account and your devices;
- communicate with you, including about updates, launches, support requests, and changes to our terms and policies;
- develop, test and improve the Services, and troubleshoot problems;
- detect, prevent and respond to fraud, abuse, security incidents and other harmful activity;
- comply with legal obligations and enforce our agreements; and
- for any other purpose described to you at the time of collection or with your consent.
3. Legal bases
Where data protection law requires a legal basis for processing, we rely on one or more of the following: performance of a contract with you; our legitimate interests in operating, securing and improving the Services, balanced against your rights; compliance with legal obligations; and your consent, which you may withdraw at any time.
4. How we disclose information
We do not sell your personal information. We do not share it for cross-context behavioral advertising. We may disclose information:
- to service providers that process information on our behalf, such as hosting, infrastructure, communications and support providers, under contracts that limit their use of it;
- to comply with applicable law, regulation, legal process or a lawful government request;
- to protect the rights, property, safety and security of Firedance, our users or others;
- in connection with a merger, acquisition, financing, reorganization or sale of assets, subject to appropriate confidentiality protections; and
- with your consent or at your direction.
5. Cookies and similar technologies
We use only the cookies and similar technologies needed to operate the Services and remember your choices. We do not use them for third-party advertising. You can control cookies through your browser settings, but disabling them may affect how parts of the Site work. If our practices change, we will update this section and, where required, ask for your consent.
6. Retention
We keep personal information only for as long as needed for the purposes described in this Privacy Policy, including to meet legal, accounting and reporting requirements, resolve disputes and enforce our agreements. When information is no longer needed, we delete or de-identify it.
7. Security
We use administrative, technical and organizational measures designed to protect personal information against unauthorized access, loss, misuse and alteration. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. International transfers
We operate in, and may store and process information in, the United States and other countries where we or our service providers are located. These countries may have data protection laws that differ from those where you live. Where required, we use appropriate safeguards for cross-border transfers.
9. Your rights and choices
Depending on where you live, you may have the right to access, correct, delete or obtain a copy of your personal information; to object to or restrict certain processing; to withdraw consent; and to not be discriminated against for exercising your rights. You may also have the right to lodge a complaint with your local data protection authority. To exercise these rights, contact us using the details in Section 13. We may need to verify your identity before responding, and we may decline requests where the law allows or requires it.
You can opt out of marketing emails at any time by using the unsubscribe mechanism in the message or by contacting us. We may still send you service and legal notices.
10. California and other U.S. state privacy rights
Residents of certain U.S. states, including California, have additional rights under state privacy laws, including the right to know, access, correct and delete personal information, and to opt out of the sale or sharing of personal information. As stated above, we do not sell or share personal information as those terms are defined by these laws. You may exercise your rights, or authorize an agent to do so, by contacting us as described in Section 13.
11. Children
The Services are not directed to children under 13, or under the minimum age required in your jurisdiction, and we do not knowingly collect personal information from them. If you believe a child has provided us with personal information, please contact us and we will delete it.
12. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. The “Last updated” date above shows when it last changed. If we make material changes, we will provide notice as required by law, for example by posting a notice on the Site or sending an email. Your continued use of the Services after an update means you accept the revised policy.
